General Terms and Conditions

of IIK Deutschland, IIK Düsseldorf, IIK berlinerID and IIK E-Learning

Participants in publicly funded courses are subject to seperate terms and conditions. These are announced at the time of registration at our offices.

 

This translation into English is for information purposes. Only the original German text has legal authority.

 

§1. General Participation Requirements

  1. All courses and programs are primarily designed for adults. Adolescents aged 16 and above may participate upon prior agreement and with a written declaration from their legal guardians (waiver of supervisory duty). Courses are not suitable for individuals under the age of 16.
  2. A computer or tablet and a stable internet connection are required for homework, self-study, and online instruction. Participants must ensure that their technical equipment and internet connection meet the requirements for online learning.
  3. Certificates of participation and admission to final examinations will only be issued upon regular attendance. A minimum attendance rate of 50% is required, subject to variation based on governmental regulations.

§2. Booking & Reservation

  1. Any written registration—whether on-site or online—including the submission of online course booking forms, is binding and obligates the participant to full payment of the booked services. Each course booking is alternatively valid for an equivalent online version in terms of content and schedule. Confirmation of registration or issuance of registration certificates will only occur once full payment has been received or an original declaration of cost coverage from a third party is provided (e.g., funding or scholarship confirmation, employer cost coverage). The decisive factor is the receipt of payment in the organizer’s account or the presentation of official payment receipts or cost coverage declarations. Only then is the course place firmly reserved.
  2. Course and accommodation places are allocated in the order of payment receipt, subject to availability. If payment is not received on time, there is no entitlement to a reserved course place. If no course places are available on the first day of the course, there is no legal entitlement to participation despite payment—only to a full refund or a later equivalent offer.

§3. Placement & Course Times

  1. Placement into a German course level is based on a placement test conducted online or at the institute. There is no entitlement to a specific course time (morning or afternoon). Course times are determined by the organizer and do not constitute grounds for cancellation. After a break of two months or more, participants must retake the placement test. The test result is binding for placement.
  2. Programs and courses have a maximum number of participants, which may be exceeded in exceptional cases (e.g., up to 25 participants in “German Intensive” courses). If the minimum number of participants is not reached, the organizer reserves the right to cancel the course or reduce the number of teaching units while maintaining the same quality and intensity of instruction

§4. Payment Deadlines

Fees for booked services must be paid in full in advance. Fees for accommodation services must be paid no later than 24 calendar days before the course begins (by 12:00 noon, German time). If full payment is not received by this deadline, there is no entitlement to continued reservation of accommodation by IIK Deutschland. Course fees must be paid by the first day of the course.

§5. Payment Methods & Fees

  1. In addition to cash payments, payments via credit card, bank transfer, and EC, credit, or debit cards are accepted. Any bank charges incurred for deposits, transfers, or similar transactions are the responsibility of the participant.
  2. For cards issued by banks outside the EU, the following fees apply on-site:

    Payments up to €399:No fee
    Payments up to €999:€10 fee
    Payments over €999:€20 fee
  3. Payment fees for purchases made through our website vary depending on the country of origin. Fee-free transfers from outside the EU are also possible using the TransferMate service.

§6. Cancellation & Postponement

  1. Cancellation or postponement of courses and programs is possible up to 14 calendar days before the start of the event (receipt of mail/email by 12:00 noon, German time). In the case of timely cancellation, all payments already made will be refunded. Cancellations must be submitted in writing. In the event of a later withdrawal, the full fee is due. Services already used will not be refunded, even partially. Additional conditions may apply to specific programs (e.g., University Pathway Program).
  2. After the start of the event, postponement of remaining course sections is possible. The request must be submitted in writing at least 14 calendar days before the next course section. The total duration of postponements must not exceed 12 months.
  3. If you have applied for a visa for courses you wish to cancel, you must provide proof that the visa was not granted or not applied for (e.g., return of original documents issued by IIK Deutschland, rejection letter from the German embassy). We reserve the right to inform the relevant authorities in Germany or the responsible German embassy of your cancellation, so that any visa or residence permit already issued may be revoked. If a cancellation is made outside the cancellation period due to a proven visa rejection, it will still be considered valid; however, we will charge fees equivalent to the minimum booking duration (one course phase) and refund the remaining amount.
  4. If you have participated in one of our “C1.2” level courses including the final exam at least once and still have booked course sections remaining, we will refund the fees for the remaining course sections.
  5. Special cancellation conditions apply to booked examinations: Free cancellation is possible up to the registration deadline. In the case of cancellation of a telc exam due to illness, the exam fee will be refunded minus a €50 registration fee. A medical certificate must be submitted by the following Monday (12:00 noon, German time) after the exam. If internal exams are rescheduled due to personal fault, they are subject to payment.

§7. Right of Revocation

You may revoke your contractual declaration within two weeks without stating any reasons, in written form (e.g., letter, fax, email). The withdrawal period begins upon receipt of this information in written form, but not before the conclusion of the contract and not before we have fulfilled our information obligations. §8. Insurance and Liability

  1. The course fee does not include any insurance coverage. Participants are responsible for obtaining their own health, accident, and liability insurance, unless otherwise agreed.
  2. Participants are liable for any damages they cause through negligence or intent, particularly damages to accommodation arranged by the organizer.
  3. For the borrowing of equipment (e.g., laptops), the additional terms of the “Laptop Loan Agreement” apply.

§9. Inability to Attend

If a participant is unable to attend a course in whole or in part after it has started due to personal reasons (e.g., illness, immigration-related issues, or personal obligations), there is no entitlement to a refund of course fees or participation in a later course.

§10. Course Cancellation by the Organizer

The organizer may cancel a booked course up to two weeks before the course start date. In such cases, suitable alternative offers will be provided. Conducting a course in an online format instead of in-person does not constitute a cancellation, provided the course is equivalent in content and schedule or if the change is required due to official regulations. Upon request, the customer will receive a full refund of the amount paid without any deductions for processing or bank fees. However, there is no entitlement to reimbursement of travel ticket reservation costs or similar expenses. Participants are advised to take out travel cancellation insurance.

§11. Teaching Materials

Unless otherwise stated, textbooks are included in the course fee. Exceptions may apply. Please check the specific conditions for your course or program at the time of registration.

§12. University Pathway Program

  1. The goal of this program is to enable participants to study at a university in Germany. If you can provide proof of successful enrollment at a German university (e.g., certificate of enrollment) or successful completion of an external exam such as TestDaF with at least 16 points, Telc C1 Hochschule, or DSH-2, you may cancel the program and we will refund the fees for the remaining course sections.
  2. This right applies only if you have regularly attended our courses (minimum 50% attendance) and passed all required interim examinations.

§13. Career Pathway Program

  1. The goal of this program is to enable participants to work in Germany. If you can provide proof of successful employment in Germany through a valid full-time employment contract (minimum 30 hours/week) and a valid work permit, you may cancel the program and we will refund the fees for the remaining course sections.
  2. This right applies only if you have regularly attended our courses (minimum 50% attendance) and passed all required interim examinations.

§14. German “Intensive, Part-Time & Standard” Courses

A certificate of participation will only be issued with a minimum attendance of 50%. Additionally, the final examination may only be taken if this attendance requirement is met.

§15. Integration & Job-Related Language Courses

For integration and job-related language courses, the “Agreement between Course Provider and Participant in Job-Related Language Courses pursuant to § 8(4) of the German Language Promotion Ordinance (DeuFöV)” also applies.

§16. One-on-One Lessons

Private lessons must be booked and paid for in advance. Free cancellation or rescheduling is possible up to 48 hours before the scheduled session. In the case of later cancellation or no-show, the full fee for the session will be charged. One lesson typically lasts 60 minutes. Lessons may take place in person, online, or in a hybrid format, depending on the agreement.

§17. Accommodation

  1. The organizer acts as the landlord of the accommodations it arranges, meaning the rental agreement is between IIK Deutschland and the participant.
  2. Fees for accommodation services must be paid in full no later than 24 calendar days before the course begins (by 12:00 noon, German time). If payment is not received by this deadline, there is no entitlement to continued reservation of accommodation by IIK Deutschland. In the case of an extension, there is no entitlement to the same accommodation.

§18. Data Protection

When registering and concluding a contract, we collect and process personal data exclusively in accordance with legal provisions, particularly the GDPR. The participant consents to IIK Deutschland electronically recording and processing their data for the proper execution of registration, billing, and performance documentation procedures. §19. Severability Clause

Should any provision of these terms and conditions of participation and payment be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

§20. Jurisdiction

Applicable law: German law shall apply. The place of jurisdiction is Düsseldorf.
